PUBLIC OFFER AGREEMENT

1. General Provisions
1.1. This document is an official proposal (public offer) in accordance with Article 407 of the Civil Code of the Republic of Belarus.
1.2. The Agreement is concluded through the acceptance of the offer by the Buyer, which is completed by making payment for the service via the Website functionality.
1.3. The eSIM online store (hereinafter referred to as the "Seller") provides the opportunity to purchase and activate eSIMs under the terms outlined in this Agreement.
1.4. The Seller reserves the right to amend the text of this Agreement unilaterally at any time without prior notice. All changes are published on the Website.
2. Terms and Definitions
2.1. Seller – A legal entity registered under the laws of the Republic of Belarus, providing eSIM sales services enabling the use of network services (Internet access) provided by third-party telecom operators.
2.2. Buyer – An individual or organization that accepts the terms of the Agreement by making a payment.
2.3. Website – The Seller's web resource located at letsim.ru (letsim.by), with online payment functionality and a personal account interface.
2.4. eSIM – A virtual SIM card represented by a software profile provided to the Buyer for telecommunications services (Internet access).
2.5. QR Code – A digital key used to activate the eSIM.
3. Subject of the Agreement
3.1. The Seller provides the Buyer with an eSIM, offering various Internet access tariff plans (packages) and access to its management via a personal account. The Buyer agrees to pay for the service.
4. Procedure for Concluding the Agreement
4.1. The Agreement is deemed concluded once the Buyer accepts the offer by making the payment.
4.2. To place an order, the Buyer must register on the Website, select a suitable tariff plan (package), and pay for the service using one of the available payment methods, including the integrated online payment system.
5. Obligations of the Parties
5.1. The Seller undertakes to:
- Provide the Buyer with an eSIM after payment confirmation.
- Ensure access to the personal account for managing the eSIM.
- Offer support and consultation regarding eSIM functionality.
5.2. The Buyer undertakes to:
- Provide accurate information when placing an order.
- Use the eSIM in accordance with the laws of the Republic of Belarus.
- Not share the QR code or access to the personal account with third parties.
- Immediately report any unauthorized access to their account.
- Avoid infringing third-party rights and refrain from using the Website or services for unlawful activities.
6. Payment and Refund Policy
6.1. The cost of the eSIM is specified on the Website.
6.2. Payments are made in Belarusian rubles or other currencies using the available payment methods on the Website, including the integrated online payment system.
6.3. Refunds for unused eSIMs are possible before QR code activation. Refunds are not provided after activation.
6.4. Transaction fees for payment services are borne by the Buyer.
7. Use of Personal Account
7.1. The Buyer gains access to a personal account on the Website upon registration.
7.2. Through the personal account, the Buyer can manage activated eSIM profiles, update data, or delete the eSIM.
8. Liability of the Parties
8.1. The Seller is not liable for:
- Incorrect eSIM functionality on devices that do not support eSIM technology.
- Interruptions or lack of connectivity due to telecom operators' issues.
- Errors or unauthorized use of eSIMs by third parties.
8.2. The Buyer is responsible for:
- The security of their account credentials (login and email).
- Maintaining the confidentiality of data provided for eSIM activation.
9. Confidentiality and Data Protection
9.1. The Seller agrees not to disclose the Buyer’s personal information, except as required by law.
10. Dispute Resolution
10.1. Any disputes or disagreements arising from this Agreement shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be settled in the court of the Seller’s registered address.
